Healthcare Behind Bars: What You Need to Know
Excerpt
Incarcerated individuals are the only U.S. citizens with a constitutional right to healthcare. In the 1970s, the U.S. Supreme Court case of Estelle v. Gamble established three basic rights of inmates regarding healthcare: prisoners have the right to access healthcare, the right to the care that is ordered, and the right to a professional medical judgment.1 In 1977, Bowring v. Godwin established psychiatric care as a component of prisoner healthcare needs. As a result, over the past 3 decades, a correctional healthcare specialty has evolved.
