The practice of medicine is regulated by a complex interplay of federal, state, and case laws. In fact, the statutes addressing health care occupy more space in a law library than the tax code. Adding to the complexity is the rapidly changing nature of the healthcare industry. As a result, courts are faced with a difficult task of interpreting the will of Congress for cases and controversies that were never even imagined at the time the laws were enacted. This Refresher Course describes health law basics and uses a case-based approach to describe current trends in health law of importance to practicing anesthesiologists focusing on medical negligence and fraud and abuse issues. Other health law topics of importance that are omitted include antitrust, peer review and credentialing disputes, state medical boards insurance, patients' rights, intellectual property, tax, hospital, and research issues as well as employment/labor law.
